Task Guidance

USCIS requires evidence that you have commanded or will command a high salary or other significant remuneration relative to others in your field.

This criterion is about proving that your compensation reflects your extraordinary standing in your profession.

  • Proof of your salary such as recent paystubs, your offer letter, employment contract, tax forms (W-2s), bonus documentation, or vested stock/equity statements
  • If you receive equity compensation: a letter confirming that your total remuneration is comparably significant relative to peers in your field
  • For non-profit employees: government wage determinations and salary comparison reports specific to 501(c)(3)/503 organizations

  • The more forms of compensation documentation you can provide, the stronger this evidence will be.
  • A combination of an offer letter, paystubs, and tax returns is more persuasive than a single document.
  • Your Attorney will research the comparable wage benchmarks.

Salary documents are used to research whether your salary is higher than the benchmarks (US Dept of Labor surveys as well as other salary surveys).
